CABO AZUL PROPERTY CLOSED
I am very distressed with having to pay Diamond International assessment fees on our home property Cabo Azul in Mexico that was severely damaged in last years hurricane. I sent the following letter to Sarah Hulme at Diamond Resorts and for two months now, there is no response or acknowledgement from her or anyone on her staff. I will direct a follow up to the CEO next -

Cabo Azul Home Property + U.S. Collection
Dear Ms. Hulme,
We are directing this inquiry to you after having recently paid both our Cabo Azul and U.S. Collection annual assessment fees in full.
We were fortunate enough to have stayed at the Cabo Azul property just a few months prior to Hurricane Odile and we were very impressed with the property and were planning to book time there on an annual basis. We were devastated by the destruction the Hurricane caused and very disappointed that the resort was to be closed until July 2015 and even further disappointed to be advised that there is now a delay until September 2015. It would not surprise us if the resort remains closed for the balance of 2015.
We purchased additional points to make Cabo Azul our home property and now we cannot use it this year and yet, we have been billed for a full years assessment. What justifies Diamond to bill out a full assessment when this resort is now closed to us? It would be unrealistic for us to believe there will be available space at the resort after September in light of the reservations already cancelled and now pending after the Hurricane.
I found the 2015 Diamond Resorts Cabo Azul Budget (attached & that was sent out with the assessment bill) to be completely unacceptable. This statement lacks detail as to complete Revenues and Expenses. Perhaps the insurance claim is not completely settled at this time however, Diamond has received some insurance compensation to date, correct? Does not Diamond’s contract with the insurer include loss of rents (income) in addition to coverage for damage? Should not the coverage for loss of income offset the 2015 assessment to members?
We would like to know what concession will be granted to Cabo Azul members in light of the final insurance settlement.
We look forward to your response on these several important questions.
Sincerely,
Gino Roth
