Whynotleaseit must be sued
Sears is illegally selling its products thru Whynotleaseit, a New Hampshire company. Sears is obviously Whynotleaseit's agent in this practice. Yet Sears misadvises and deceives u on the terms of the contract--telling us that we'd be charged only 6% interest, with NO mention of the illegal-under-Michigan-law "balloon" payment. In addition, the purchaser had to sign on a computer screen BEFORE seeing or being given an opportunity to read Whynotleaseit's "contract" (which is just the receipt). I've done some research and Whynotleaseit's receipt "contract" sure seems to violate Michigan's rent to own statutes in several ways. We want to keep the toolbox. In my legal opinion, this contract is illegal and thus void- so the purchaser need not honor it. We plan to so advise Whynotleaseit, and simply give Sears and Whynotleaseit a letter with a cashiers check- made out to both of them- for the original purchase price. Let them try and sue us. Or, beware- these scurrilous rent to own companies have been known to seek to have u ARRESTED for "stealing" (ur, failing to return) their "leased" products. I saw some such activities occurred - not with Whynotleaseit, but other rent-to-own companies- using the DISTRICT ATTORNEY to seek to have the purchaser ATRESTED! Ohhh.. if Whynotleaseit they tries that, there's a damages clause in the statute, plus attys fees. We'll see them in court.
