Discrimination Against Disabled Veterans

As a member of the sons of the legion as post 363 in Lakeville Indiana I can not believe I am going to post a "complaint" against MY American Legion. I am a every week attending, membership paying, patron on the American Legion and I regret to inform you that post 363 is losing customers and paying members at the hands of a Son's of the Legion Ptesidents's sister. I was in my local legion when a argument went about with 2 women of the legion. As a off Duty officer of the local police department and a government employee Observed a lady getting "snippy" with other membership holding patrons. As a off duty officer I stepped in to extinguish the fight and I was told by your Son's of the Legion "president" that, that is not my place. Ok not only as a sworn police officer of the law but as a paying member for several years, I do not expect this or condone it from MY American legion. I am disappointed and out raged to hear that the young woman I am talking about is also a auxiliary President at the Lapaz Indiana post.?!? I will NEVER return as long as this is Ok and condoned by MY American Legion.

Discrimination Against Disabled Veterans

Once again I am a government employee and a member of the SOL and I will NEVER step foot in this American Legion as long as it's "ok" to upset 7 other paying members enough to leave as longs as it's ok for a president of the SOL to allow this to go on?!?!?

dictatorship and abuse of power

My complaint is of the present commander of American Legion post 241. The post is run like a night club and the commander is making decisions without consulting the body and running the place like it is his. We at the post 241 are very tired of this kind of leadership or lack of to pay our dues and not have a voice in what is being done at our post. We have had the police remove members because we voice our opinions we need someone to look into this matter and handle this problem before it gets out of hand. I did not serve my country fighting for democracy and be led by dictatorship. My advice is that you do not ignore this complaint because is a very serious matter.

complaint against officers of abuse of power

I have been a member of good standing for many years Slickville Post 18 was a good friendly post to be at. Now we have officers that don't care about members and one that thinks he can do anything he pleases. He hires and fires people docks the pays , takes decuction out without asking. He messes with the camera's . He thinks that the Legion is his and he will run it the way he wants and he isn't the Commander he is the home Association president. The Commander is afraid of him I think and nobody will stand up to this guy for that fact he will fire you. The Legion is an We and US!! We Can't be a WE and US when he is hurting everybody there. We need for him to go and we can't get him out. It's like having the devil there!! I am one person I go to all meeting and I have gone to hire ups and I can not get no help. The guy is a con man he will sale you a car with out wheels and the people down there will buy it cause he has it. The members turn a blind eye cause nobody will step in and help with anything while he is there. We need help is there anything anybody can do to help this post out before it really goes down.

Assault, Slander

My name is James F. Draker .I was a volunteer bartender at A.L. post 801 Bombay beach ,Ca.92257 I am on disability & worked for tips only. I have had several close family friends who had been officers at the 801,whom I respected very much and are no longer with us.So I always conducted myself in a manner that they are watching!! Mr. Rudnick "Post Commander" Accusess me of stealing his motorcycle tag back in 2001. I tell him "I've always liked him & besides that I'm not a thief!!" A few days later,I'm Bartending, He's had a few!! And calls me a "Drug adict,A Thief,& a Lier!!! So I told him "That's three, any of those three are fighting words, If need be we can step outside the fence! Then I said "I Think you need to leave now!!!& stepped back as he tried to snatch me from behind the bar!! Just so you know "Rudy" is not a small fellow!! he had to be stopped from comin behine the bar and getting clubbed with a vodka bottle!!! A friend talked him into going outside and after about 45 min. he left. The next day said sorry, all was good for a few weeks, until sum garage was missing some dune buggy parts & he looks at me & says"You just got a sandrail that needs restored! Didn't you?"Well I found my 2001 registration & Ins. papers for that motorcycle I had, stuffed them in an envelope with a letter that read" Disrespect me again like that. And we WILL fight! No fear here, & you aint that big!!!Not to mention the photo's I took on the 801 porch of the topless woman & our naked Commander!!!!! But because of the envelope I put on "His" porch, I'm not welcome at the post! But the former Ass.Manager "Richard Pettipass" who sexualy harassed a 17 yr.old volunteer,& friend of mine's daughter, is allowed back in! Please take care of this! I don't like jail!

My American Legion Represenative Did a Poor Job At My BVA Hearing

I am an honorably discharged Army Veteran. I believe the American Legion and the Veterans Administration have treated me unfairly. No other Veteran should have to go through what I have had to endure. The evidence will support that Curtis Cutler of the American Legion sabotaged my appeal for an earlier effective date at my Board of Veterans Appeals (BVA) hearing in July 2014. The evidence will also show that the BVA never mailed me the denial letter in question, which is at the crux of this matter.
I initially filed my claim for PTSD in 2001; it was denied and I appealed it twice. The VA alleged that I never filed an appeal to their 2004 denial therefore I refilled my claim in 2005. I was granted service connection for PTSD in 2013. I filed a claim for an earlier effective date in 2013 to include the 2001 date of my original claim. At my hearing in 2014 I was confused and assumed the VA had sent me the denial letter in question, therefore when asked by Curtis Cutler what did I do when I received my denial from the Board, I responded, “I filled it out and mailed it to my Regional Office (RO) as I always had done.” The cause of the confusion is I had received two denial letters prior to the one in question. In the past I filled out the form to appeal the denial letters and mailed them to my RO in Roanoke, Virginia.
I would later learn, through the BVA denial letter dated AUG 8, 2015, that this particular appeal did not come with a form to fill out and mail to my RO. That particular appeal, had I received it, should have been mailed to the US Court of Veterans Appeals in Washington, DC. My American Legion representative, Curtis Cutler, should have known that when he coached me on the morning prior to the hearing. Cutler allowed me to state at my BVA hearing that I received the Boards denial letter in the mail, and I filled it out and mailed it to my RO.
After I received the Boards denial letter dated AUG 18, 2015, I wanted to file a complaint against Cutler. His supervisor told me that Cutler had been assisting Veterans at the Board for three years. It is my assertion that since Curtis Cutler had been assisting veterans for three years he should have known that that particular appeal did not go to my RO, and that it had to be mailed to the US Court of Appeals, yet Cutler did not to tell me that. At no time did Curtis Cutler mention that I should have mailed my appeal to the US Court of Appeals. At the very least Cutler is guilty of dereliction of duty and at worst Cutler deliberately caused me to have my appeal denied.
When Curtis Cutler briefed me in that room, the moment I told him that I mailed the appeal to my Regional Office as I always had done, he should have informed me that that appeal should have been mailed to the US Court of Appeals. Had Cutler done that we could have explored the possibility that I never received the Board’s denial letter, as acknowledged by the Board in its denial letter dated AUG 18, 2015 on page 8.
In the denial letter on page 8 the BVA stated, “The Veteran and his representative were mailed a copy of the Board’s decision, along with a VA Form 4597. Although the cover letter to this decision is not of record, the Veteran expressly acknowledged having received a copy of the Board decision in the mail during the July 2014 hearing. (“How did you become aware that the board denied your service connection claim for PTSD?... I got it in the mail.”). Although the copy sent to his representative of record was initially returned as undeliverable, it was resent to the Washington, DC RO location of the representative in October 2014. The BVA never mailed me a denial letter in 2005. The denial letter should have been mailed to me in 2005 not 2014 as the BVA stated was when they mailed it. According to the BVA my denial letter was mailed nine years too late!
It is my contention that Curtis Cutler deliberately withheld vital information and in so doing caused me to have my appeal denied at my BVA hearing in 20014. As my representative, it was Cutler’s duty to assist me with winning my appeal instead he was instrumental in the BVA denying my request for an earlier effective date. I find Curtis Cutler’s behavior, on behalf of the American Legion, to be truly reprehensible.

Evidentiary Timeline of events:
• Represented by American Legion’s Curtis Cutler at BVA hearing in July 2014. Prior to my hearing before the Board Cutler informed me that he was going to go to his office and look at my file, and that he would be be back in about 15 minutes. When Cutler returned he took me into a room to to go over my testimony.
• Cutler asked, “ How did you receive the Boards decision?” I replied, “I got it in the mail. I got all of my decisions in the mail” Cutler stated, “Just answer the questions that I ask you.” Then Cutler asked, “What did you do after you received your denial letter from the Board?” I replied, “I immediately filled it out and mailed it to my Regional Office in Roanoke, Virginia, like I always did whenever I received a denial.” Again Cutler said for me to just answer the questions that he asks and to keep it brief.
• Again Cutler asked, “How did you receive your denial from the Board? I replied, “I got it in the mail.” Again Cutler asked, “What did you do after you received your denial letter from the Board?” Again I replied, “I immediately filled it out and mailed it to my Regional Office in Roanoke like I always… at that point Cutler interrupted me and said, “Just answer the questions that I ask you.”
• Again Cutler asked, “How did you receive your denial from the Board?” I replied, “I got it in the mail.” Again Cutler asked, “ What did you do after you got the denial letter from the Board?” I replied, “I immediately filled it out and mailed it to my Regional Office.” At that point Cutler said that’s good and we went to the hearing room.

Asian Americans Discrimination

I am writing this to alert any Asian American who has joined the American Legion or who are considering joining the American Legion in New Jersey Bergen County you will face discrimination at many of the legion post. The only place that you should join is a place where Asian Americans have been able to thrive and grow over the years in the only Asian American Legion Post China Town with over 650 members. The American Legion promoted segregation because they did not care if Asian Americans joined the legion or not although many of us proudly served. Right now many of the legion posts are dying out and are closing one by one due to the discriminatory nature of those that remain. I listed those members of the American Legion who are bigots, Bergen County Adjutant Sophia Damascus Little Ferry, Ron Beattie Oakland Post 369 and John Harris Post 369. As the American Legion posts continue to close in Bergen County it may be a good thing since many of the legion posts no longer have active members and tax payers money and donation are no longer serving veterans but the interests of those remaining. Giving money to family as gifts or friends without considering making sure the money is spent on veterans, becomes a conflict of interest issue. Bergen County Legion Posts should return all the money to national headquarters. The only way to save the American Legion is to continue to watch it shut down and then, only when the remaining are gone will the mission of the American Legion may be able to be revived. I no longer donate a dime due to my impression that the culture of the American Legion is anti American with being an organization that promotes with an unwavering commitment to social justice and the American way of life. I love the name of the American Legion since it reminds me of the Roman Legions and those warriors. The warrior spirit is gone in the American Legion.

Commander failing to follow protocol

During election times two people running for Commander 23 votes were cast one person received 13 the other Commander running receive 10 unfortunately I looked into the books and found that there was only 20 members that were signed in I'm not arguing to the senior that became the commander a Myron that the commander failed to follow protocol and should have matched up what was actually cast votes and how many people signed in the book this is unprofessional and the commander failed to follow protocol post 96 Cicero
